First appeal of the appellant was dismissed on the ground that 25% of the additional demand comes to approximately to Rs.61117/- which is required to be deposited. In view of the provision of Section 15(3) of the PVAT Act and as per the law laid down in M/s Surya Pharmaceutical Ltd. Vs. State of Punjab 2015(1)NTR 423, the amount of ITC available can be carried forward and adjusted towards the amount of pre deposit.
In view of the above said circumstances this appeal is allowed. The appeal No. 140 of 2018-19/CST can be heard on merits without making any pre deposit in view of the above circumstances. This appeal is allowed, the order dated 11.12.2019 passed by the First Appellate Authority is hereby set aside and the appellant is directed to appear before the First Appellate Authority for reconsideration of the appeal No. 140 of 2018-19 on merits without making any pre deposit in the second week of January, 2022.
